poland lost their first match to latvia. and trying to even the score. the only team in the group that really does not have much of a chance is the team from south africa. they are 0-2 and not in this class. >> this is a pool that i described as easy to get out of but tough to win. >> poland on a 9-5 run since the technical time-out. can they secure victory? prudel. off rosenthal. out of bounds. and now poland, one point from the upset. remember, this polish team has never secured an olympic victory. so not only are they about to pull the upset, they're about to win if they can pull it off. their first ever olympic competition. >> crowd rises. >> 20-16.

dogs. vicky nguyen investigates the possible link to a popular treat. good afternoon. i'm janelle wang. >> i'm jessica aguirre. we're on with you a little earlier and we will be throughout the next two weeks. we'll begin at 4:00 for the next two weeks, bringing profiles of the bay area athletes and some of the fun behind the games. >> tonight we start with a local business where olympic dreams are born. i'm talking about a popular ice skate rink where kristi yamaguchi perfected her style. nbc bay area's mary ann favro has more to tell us about the fight to save it. >> reporter: the owners of this mall want to tear this ice rink

down and put in more stores. but thousands of skaters who use this rink says the community needs recreation much more than retail. >> ice chalet in san mateo is a rink on the brink of closing. the sbi holdings says it will not renew the ice center's lease when it expires in may. instead, it wants to tear down the rink and put up more lucrative retail stores. 8-year-old says that hurts more than falling on hard ice. >> i think it's very sad. >> reporter: why? >> because i love ice skating a lot. >> reporter: so do a lot of other people. the rink is open from dawn until 1:00 in the morning, offering everything from camps to adult ice hockey leagues. each year more than 150,000 people lays up to glide or at least try to on this ice. >> as a mom, i can tell you there are not a lot of things for kids of any age to do or things that i can do with my

kids. this rink means so much to so many people that have grown up here. >> reporter: including olympic gold medalist kristi yamaguchi who trained here for several years. sbi is asking the city to whang the master plan. sbi did not respond to our request for a comment. the recreation department is reviewing the proposal. for now, this rink remains on thin ice. >> you can see behind me there's a sign on the door encouraging people to sign a petition. so far they have collected more than 2,000 signatures to help save this ice rink. reporting live in san mateo, mary ann favro, nbc bay area news. the big steel beams are going up, the new stadium for the 49ers is taking a huge step forward today with crews bolting down the project's first real support pieces. nbc bay area dammann trujillo

has more for what it means to the local real estate. to see it for real must be really cool. >> it really is. this is creating a buzz in the local ream estate community. this stadium is going up behind me. there's workers back there right now doing their thing. at 6:30 this morning, crews put in the first steel beams on this 1.2 billion project. that means the construction company should hand over the keys to the 49ers in a couple of years. no one could be happier than homeowners and real estate agents in the surrounding area. one agent told me he's seen prices rise up to 4% in the last few months alone. it won't be long before he'll be able to use the stadium as a marketing tool while selling homes in santa clara. one family selling their home in the river mark area says they can't believe the response. >> we've had the house on the market for approximately three weeks, and we've had over a

hundred groups. that includes families. several people coming through here. >> reporter: the agent told me some families who wanted to buy even four months ago are now being priced out of the local market. he's not sure if the stadium is the reason, but he is sure it's not hurting his cause. the mayor says even commercial property, empty lots have sat vacant for ten years and more and longer here in santa clara, there's now a bidding frenzy for those. kickoff here in santa clara, 2014. live at 49ers headquarters. the suspect in the colorado shooth massacre has been formally charged in this case. today 24-year-old james holmes appeared in a denver courtroom to hear the charges against him. observers say he appeared far more aware and alert of what was going on than his first court appearance. he's accused of killing 12 people and wounding 58 but is being charged twice for each

victim. 24 counts of murder and 116 counts of attempted murder. the maximum under colorado law. if found guilty on all charges, holmes could face the death penalty. swreel much more on today's developments including the victims who showed up for today's hearing in 30 minutes. jury selection also began today between apple and samsung, a $2.5 billion lawsuit that could change the smart phone industry. several hundred potential jurors filed into the courthouse in san jose today. the judge addressing them saying, quote, this will be an interesting case. a patent expert says it will test the boundaries that cover design and the look and final of a product. california's high speed rail could one day whisk you from the bay area to las vegas. private developers are gambling on a plan to build a second bullet train from las vegas and link up in the city of palmdale in north l.a. county. the last vegas backers hope the

obama administration will provide a record loan to kick start construction of the $8 billion rail line. the trip from san francisco to las vegas would take four hours if it's approved. the las vegas bullet train is at least ten years away from completion. okay. day three of the 2012 london games and a dramatic day for bay area athletes. we need to issue a spoiler alert here. one of our stories involves a young woman whose performance has moved her into prime time coverage tonight. we'll play music and put up results for 15 seconds. if you don't want to know, turn away when you hear us talking about the women's water polo team. ♪

okay. you can open your eyes again. a new olympic record, water polo athlete maggie stefan scored seven goals in team usa's 14-13 win over hungary. she grew up in danville and going to stanford. another bay area athlete is making history. kerri walsh is in action playing her second qualifying games of these olympic games. before she hit the beach volleyball court, she sat down with nbc bay area news anchor raj mathai. >> reporter: tonight we're going to turn the camera around on the other side of the buckingham palace, down the mall as they say in britain. kerri walsh has gone through major life changes in the last few years, the proud and happy mother of two young boys. also some drama on the

complaints that jerky treats have sickened or even killed pets. a local dog died within 48 hours of eating two treats. investigative reporter vicky nguyen joins us more with what scientists found. >> one of the first necropsies on a dog that died shortly after eating the treat. scientists say it includes another clue into the mysterious illnesses into the pets. the dog's owner is get leading the charge to get stores to stop selling the fight. they're asking the fda why it hasn't issued a recall. >> it's just funny. jack is my guy. cali was mamma's guy. >> rachel claimers' four dogs are familiar limit she said three of them became sick after eating milo's chicken jerky

treats made by del monte. >> she was sick for a couple days with diarrhea. >> reporter: but it was shepherd mix cali who couldn't be saved. it was violent and she did not deserve the way she died. cal i's veterinarian says he's seeing more own rs bringing in sick dogs after feeding them chicken jerky treats. >> you think these are dangerous. >> even if they're causing vomiting or diarrhea. >> reporter: the fda issued three warnings since 2007 saying chicken jerky treats may be associated with illness in dogs. more than 1800 complaints have been sent to the fd afrnlts about these treats. the agency posted a fraction of those records. we found the brands with the most complaints were wagon train made by necessarily and kingdom pets. despite the fda warnings, the treats are still on shelves at target, walmart, costco, petco and pet smart.

spokes people say no recalls have been issued by the makers or the fda. they have no plans to pull the products. the other stores have no comment. pet owners have turned to the internet to stop sales of these fro ducts. a petition against nestle has more than 66 thouf signatures. bay area chain pet food express doesn't sell any treats on the latest complaint list but it has posted the fda warning to educate custers in. >> we know our customers are going to have questions about chicken treats. we want to give them as much information as possible. >> reporter: the co-founder michael leavy says they haven't recorded a difference between chicken treats from china and those from the u.s. >> we couldn't carry anything we wouldn't feed our own pets. >> reporter: the fd afrnlts says it's tested for bacteria, mold and chemicals in nearly 300 complaints sent in by consumers. anguished pet owners are pursuing two class action lawsuits against del monte and

pure rena. >> the fda has gone down to china and inspected the facilities, but we can't get the results of that. >> reporter: del monte and necessa northwest li nestle, posted this video to show how the treats are made. kingdom pets post testing data on their sites and say they come from the same players from kfc china and mcdonald's china and never tested positive for known contaminants. in cal i's case the maximum recommended portion is between four and five pieces. rachel says cali ate just two treats. >> we didn't give them the entire bag. even if i gave them a whole bag of treats. if you ate a box of ding dongs, you're not going to die. >> reporter: the vet found that

monday through friday during the duration of the games. dramatic details emerging from colorado. james holmes accused of plotting and killing out a rampage in a colorado theater was back in court today. >> his demeanor was much different than his first court

appearance last week. nbc's jay gray has the latest on the case from colorado. >> the red dye in his hair looks to be growing out and james holmes was clearly more alert and responsive as he listened to the official charges read aloud. 116 attempted first degree murder charges for the 58 injured, two counts for each victim. one charge included murder with deliberation. the other cited murder with extreme indifference to the value of human life, lives like veronica mozier. her mom ashley was paralyzed from gunshot wounds to the neck and abdomen. she also suffered a miscarriage after the attack. >> it was very important to come today to see him, who he was and there was a lot of anger. >> dozens of family members and several survivors of the shooting spree were drawn to the courtroom today. >> when we've seen him before, he looked like he was kind of

spaced out or out of touch. he looked very, very alert today and very lucid as to what was going on. >> reporter: much different than this bizarre scene during his first appearance, when he seemed dazed and disengaged. today holmes acknowledged the judge, talked with his attorneys and spoke for the first time publixly during the brief proceeding, answering yes when asked if he wanted to waive his right to a preliminary hearing. >> he had an expression and kind of a persona of evilness to him, but he looked very sane to me. >> reporter: his fate could ultimately hinge on how court appointed doctors evaluate holmes in this emotional, high-profile case. along with 140 murder or attempted murder charges in this case, prosecutors have also added criminal violence and possession of explosives, citing

in the latter the cash of bombs pulled from holmes' apartment. a bay area lawmaker is demanding change after a santa cruz woman was killed on a party bus. the c hfrnltsp says it happened before midnight friday when two women were fighting on the bus. somehow they fell out of the door. authorities say 25-year-old natasha noland was killed. the second woman survived with scrapes and bruises. assemblyman jerry hill is trying to get a bill passed to tighten regulation opinions party buses. >> it will hold a mature 25 or older individual responsible in the future. that's what we'll hoping that will stop this from occurring. >> if the bill passes, it could go into effect as soon as january 1st. solyndra has filed a chapter 11 reorganization plan. the company made headlines last year just days before federal

agents raided the property seeking evidence of fraud. before that solyndra was flying high, receiving $500,000 loan and a personal visit from barack obama. twitter is at the center of a controversy tonight. a swiss athlete was booted from london for a racist tweet today. it comes one week after a greek triple jumper was banned for tweeting a politically incorrect joke. while that was happening, many athletes started a mini protest against the international olympic committee for a rule they say hurts their pocketbooks. our live coverage continues with mike barger live from london for us. mark? >> reporter: good evening, jessica and janelle. a beautiful day here and a lovely evening here in olympic park in london after a picture perfect day that saw action on the field, on the court, in the pool and in the press. as kayakers navigated the

treacherous white water slol lom curse, officials were dealing with rough waters of their own, continuing controversy over empty seats in olympic venues. most apparently were tickets allocated to no-show sponsors and olympic officials and athletes. while hundreds of the seats are being returned to public use, complaints continue. >> it's infuriating because so many people haven't been able to get anything at all. >> reporter: on the positive side of the olympic coin, london is getting high marks for moving the millions of people who headed to work on this the first day of weekday competition. london transport officials predicted an extra 3 million olympic journeys a day. >> it's a breeze. >> reporter: in competition michael phelps advanced in the 200 meter butterfly as allison schmidt and miss see franklin advanced in the women's 200 freestyle. outside the field of play,

frustrated athletes including u.s. sprinter sonia richards ross are taking to twitter demanding a change to rules that currently bar athletes from using their own names or likenesses in advertising during the games. >> the majority of track and field athletes don't have sponsors and don't have support to stay in the sport. a lot of my peers have second and third jobs to be able to do this. >> reporter: but for all of the athletes, the competition in london remains job one. when it comes to getting the job done, the women's indoor volleyball team did that today. they won in four sets. later tonight in prime time you'll see the u.s. women's basketball team taking on angola. >> what else? men's gymnastics tonight as well? >> reporter: yes, that's right. the team final in men's gymnastics. the u.s. comes in as the front-runner into the final round. we'll see if they can live up to that expectation that they established over the weekend, also a lot of swimming.

>> stroke for stroke, the women's lightweight double skulls are heavyweights in the water, totally in sync. while they may look at ease gliding across that water, rowing is no london cup of tea. it's about strength, stamina and endurance. >> i think it is deceptive when people watch it. they think it looks so beautiful and fluid and you don't realize how hard we're working. we're killing ourself. it takes a lot of hours of training together to make everything match perfectly and make the flow of the boat through the water feel like it's working the way we wanted it to. >> julie nichols and kristen head strom teamed up more than a year ago and trained in the east bay with cal's women's crew coach, dave o'neill. he was also nichols' coach at cal. >> he's seen my entire rowing career. it's great he probably knows more about me and myrowing than

anybody else. >> it's been a long time coming for nichols who was an alternate in the 2008 beijing games. >> i think it's going to be a totally different experience. i'm excited about it. >> they know all about excitement, competing in a very close olympic qualifying race. >> nail-biter all the way from start to finish. over just about a seven minute race we qualified by .09 second. >> qualifying back in may has allowed the pair to fully concentrate on the london games. >> nice and easy, nice and long. >> reporter: a key component of their training involves maintaining a certain weight. >> kristen and i together have to average 125.67 pounds and neither one of us can be over 130 pounds. >> reporter: the phd mechanical engineering student talks about their weight like a precise mathematician. >> we both have our target weights and weigh in two hours before and race. so it sets up a nice routine for

the alameda food bank has food for those in need but not enough help to get it out. the warehouse is full of ripe and delicious fruits and vegetables but volunteer ranks are thin. the food bank normally gets about 100 volunteers a day. this summer they don't have any at all on some days. that means some of the produce is going to waste, rotting before it can be delivered to people who need it. >> we have truck loads of

camera network. in san francisco, a lot of the fog is getting compressed down. it's also a big time sign of the warming trend that's moving in right here across the bay area. let's take you over to london. there it is. the olympic flame at the stadium. it traveled for 69 days to great britain and coming into contact within ten miles of most of the major cities in great britain as 13 million people lined those streets. let's get you back to the weather boards right now. what we're going to take a look at is where some of the warmest weather is at the current moment. with the winds out of the northwest, we'll see temperatures warming up across the peninsula and the south bay. 90 in sunnyvale, 97 in livermore and 94 down to gilroy. now, the overall weather story hasn't changed a whole lot over the past three days, but the big focus we continue to be honed in on is back out across the pa sick, this huge region of high pressure is going to continue to stay in place, helping to warm the numbers up.

if it was too hot for you today, you might find tomorrow completely uncomfortable. at the coastline, it's not going to get majorly warm, 60s and 70s, and back across the east and the south bay, 80s to also 90s returning even into wednesday's forecast. we'll begin with low to mid 50s into the north bay. not so bad in concord with 57, 58 in san jose and 56 in the almaden valley. as far as your tuesday forecast goes, we'll top out at 89 in san jose, 91 in los gatos. some of the warmest weather looks to be morgan hill at 94. 96 in gilroy. for the east bay, we top out at 4 at walnut creek, 94 in pleasant ton and pittsburgh. about 10 degrees above average. we don't think record setting at this point for tuesday. also going into the 70s, a very rare july day here in san francisco with 72, 78 also rare for you in oakland. 90 in sonoma and napa and 92 in
